Terms of Sale
By placing an order, you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible. 
 
In order to contract with Cheezelo Limited or www.cheezelo.com  you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. www.cheezelo.com  retains the right to refuse any request made by you. If your order is accepted, we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be www.cheezelo.com  or may in some cases be a third party. Where a contract is made with a third party www.cheezelo.com  is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products imported and services may fluctuate. All prices advertised are subject to such changes at any time without notice.
 
(a)   Our Contract 
 
When you place an order in the UK, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been accept for dispatch to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
 
(b) Pricing and Availability
 
Prices quoted by Cheezelo Limited include all taxes applicable to sales in the UK and are invoice in GBP sterling at the time you place your order and are not inclusive of delivery charges unless stated under the products description.
 
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it without any penalty. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
 
Delivery costs will be charged in addition except for the membership subscription where you will need to enter a coupon code; such additional charges are clearly displayed where applicable and included in the “Checkout”.
Our products are subject to availability. If we are unable to supply the goods, we will information you as soon as possible and offer you an alternative. If you will not accept the alternative proposed, we will perform a refund given you have already paid for the goods.
 
(c) Payment 
 
Upon receiving your order we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorisation being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been despatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email.
We can only accept payment with major credit and debit cards using our secure online checkout. We cannot accept cash or cheques payment online. Our secure gateway partner Stripe will request your card issuer for authorisation of the amount stipulated in the “checkout” cart. If we get a valid authorisation, your card issuer will hold this value expecting a charge from Cheezelo Limited.
 
(d) Delivery
 
We cannot deliver goods to an address outside of the delivery area specified on our website (refer to delivery page).
We will endeavour that deliveries are made within the shortest possible time and accordingly. It is the customer’s responsibility to ensure that an appropriate and authorised person is available at the delivery address to receive the goods. If you have any restrictions which needs to be known for our delivery partners, please leave a note in the box “note to seller” when checking out your order. We recommend that you provide a contact phone number for delivery purposes too.
 
if you or no other authorised person are present at the time of delivery, our partner will take the goods back to the depot or destroy them (for nationwide delivery) and no refunds will be made for your order as the goods are perishable. Similarly for London local delivery, the goods will be taken back to Cheezelo premises and disposed of. A new order will need to be raised. No refund will be given.
 
  
All our next day deliveries of perishable food are contained in an isolated box containing innovative ice gel packs which keeps the goods at the temperature required below 8 degrees Celsius.
 
e) Goods

Where our goods are perishable goods with a short date before expiry, your statutory right to withdraw purchases within the 14 day 'cooling-off' period does not apply.
Your statutory right will only apply for non-perishable or fresh foods where the expiry date is over 14 days from the date of order.
 
The appearance, shape, size, weight, descriptions of our cheeses and fresh products may vary from time to time. We may alter the product specifications of items displayed on our website without prior notice. The packaging of our products may also vary from time to time, but this will not affect the contents and quality for the products ordered.
Where our cheeses and cured meats are freshly cut by hand, weight may slightly vary, we will always ensure to satisfy and make up with more with another if we are below the agreed weight of sale.
 
Our goods are stored and prepared following local health & safety regulations, we take no guarantee in terms of health or dietary benefits of our products.
We also do not recommend to use our services if you have allergies. You may still order our products by contacting us and discussing your allergen requirements, however you will order at your own risk and we shall not be liable in respect of the allergenic content of the goods.
 
f) Cancellation and refund
 
In reference to the above sections stipulated in the Terms of Sale, you can cancel your order giving that your cancellation request is received before your items have been dispatched, we will cancel your order and refund you in full without charge.
 
A “cooling period” of 14 calendar days can also be applied for order made before a dispatch has been performed.
 
For non-perishable food or perishable food already delivered, with less than 14 calendar days expiry date from the order date, you have a legal right of a “cooling period” within you can cancel the contract for any reasons by contacting us. A full refund will only be applicable given the goods are returned unpacked, unused in their original packaging at the right temperature (using the ice gel packs where applicable). You will be liable to pay for the return of the Goods to our premises. Once received, we will contact you to perform a full or partial refunds based on the conditions of the products returned.
 
We may ask you the reasons for cancellations to improve our future services.

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law www.cheezelo.com  and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect Cheezelo Limited's liability for death or personal injury arising from its negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. www.cheezelo.com shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services or Goods and/or any page of this Website.
 
Invalidity
If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Cheezelo Limited.
